§ 1 Scope and Provider

1.1 These general terms and conditions apply to all orders placed by consumers (§ 13 BGB) via the online shop of the company Fussmatten Welt, Mozartstr. 18, 76761 Rülzheim.

§ 2 conclusion of contract

2.1 The product presentations in the online shop are used to submit a purchase offer. By clicking the button [Buy Now], you are making a binding purchase offer.

2.2 We can accept your order by sending a separate order confirmation by email or by delivering the goods within five days. The receipt of the order is confirmed by an automated e-mail immediately after the order has been sent and thus represents an acceptance of the contract.

2.3 If our order confirmation contains typographical or printing errors or if our pricing is based on technical transmission errors, we are entitled to contest them. Payments that have already been made will be reimbursed to you immediately.

§ 3 deviation or tolerances

A size tolerance of +/- 5% is production-related and material-related; there may be a deviation in the offered gauge blocks within this range. If a fixed size is to be produced, we recommend cutting the doormat to the desired final size. The doormat is then delivered without a rubber edge and must be cut to size on site. We recommend choosing the mat 5% larger here. There may be color deviations with regard to the representation on paper or on the screen and the delivered goods.

§ 4 prices

The prices stated on the product pages include the statutory value added tax and other price components.

§ 5 shipping costs

5.1 For delivery within Germany, shipping is only € 6.90.

§ 6 Terms of Delivery and Reservation of Self-Delivery

6.1 Delivery takes place within Germany with UPS and GLS. In the case of international shipments, the package is handed over to the responsible shipping company in the respective country.

6.2 Unless otherwise stated in the offer, the delivery time is approx. 5-8 working days.

6.4 If not all of the products ordered are in stock, we are entitled to make partial deliveries at our expense.

6.5 If the delivery of the goods fails despite three delivery attempts, we can withdraw from the contract. Any payments made will be reimbursed to you immediately.

6.6 If the ordered product is not available because we are not supplied with this product by our suppliers through no fault of our own, we can withdraw from the contract. In this case we will inform you immediately and, if necessary, suggest the delivery of a comparable product. If no comparable product is available or if you do not wish a comparable product to be delivered, we will immediately reimburse you for any services you have already provided.

§ 7 terms of payment

Payment can be made either on account, credit card, instant transfer or PayPal. If you pay by credit card, your account will be debited when the order is completed.

§ 8 retention of title

The goods remain our property until they have been paid for in full. Prior to the transfer of ownership, pledging, assignment as security, processing or redesign is not permitted without our consent.

Consequences of the withdrawal

If you withdraw from this contract, we will have given you all payments that we have received from you, including delivery costs (with the exception of the additional costs that result from choosing a different type of delivery than the cheapest standard delivery offered by us have), to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment. We can refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is earlier.

If you finance this contract with a loan and later revoke it, you are no longer bound by the loan contract, provided that both contracts form an economic unit. § 10 right of return in addition to the statutory right of withdrawal

10.1 In addition to the statutory right of withdrawal, we grant you a 30-day right to return goods from our shop. Exchanges are excluded for individually made mats.

10.2 You can exercise your right of return by sending back the goods received without giving any reason within 30 days. Only in the case of goods that cannot be sent as a parcel (e.g. bulky goods) can you also declare the return by means of a return request in text form. The period begins with the receipt of the goods by the recipient.

10.3 Timely dispatch of the goods or the return request is sufficient to meet the deadline.

10.4 Items that can be sent by parcel post are to be returned at our risk. You have to bear the regular costs of returning the goods if the goods delivered correspond to the goods ordered and if the price of the goods to be returned does not exceed an amount of € 40 or if you have not yet received the consideration or a have made the contractually agreed partial payment. Otherwise, the return is free of charge. Items that cannot be sent as a parcel will be picked up from you.

10.6 In the event of an effective return, the mutually received services are to be returned and any benefits drawn are to be surrendered. In the event of a deterioration of the item and for uses (e.g. advantages of use) which cannot be given or can only be given in part or only in a deteriorated condition, you must compensate us for the value.

10.7 Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you with the dispatch of the goods or the return request, for us with the receipt.

10.8 In order to be able to make use of your right of return, you should avoid damage and soiling, do not wash the items or remove any labels, and return the goods to us in their original packaging with all accessories and all packaging components. Otherwise we have the right to assert a reduction in value or to refuse to take them back.

10.9 Please use protective outer packaging for the return (special blankets should be sent in outer packaging in addition to the actual box).

10.10 When re-ordering individual mats, there may be material deviations, and color deviations are therefore also possible.

10.11 Please send the goods back to us as a postage paid package or a package with our return sticker / parcel label, otherwise we will have to deduct any additional costs from the reimbursement amount. Please keep the delivery receipt.

10.12 We ask you to keep the goods safe and rainproof before returning them.

10.13 The statutory right of withdrawal remains unaffected by the above provisions (Sections 9.1 - 9.11) in any case.

10.14 There are no claims for defects that arise for the buyer through natural wear and tear or, after the transfer of risk, as a result of improper care, installation or treatment. After cutting or otherwise started processing of the delivered goods, any complaint about obvious defects is excluded.

10.15 The buyer's claims for defects and damages expire if the buyer attempts to make improvements on an unturned basis.

10.16 A complaint is excluded after the goods have been cut to size or after they have been used.

10.17 Complaints must be communicated to Fussmattenwelt in business dealings immediately, but no later than 14 days after delivery (obvious defects) or discovery of the defect. Otherwise the assertion of deficiency claims is excluded.

§ 11 Warranty

The warranty is subject to legal regulations.

§ 12 liability

12.1 We exclude our liability for slightly negligent breaches of duty, provided that these do not concern essential contractual obligations, damage from injury to life, limb or health or guarantees or claims under the Product Liability Act are affected. Essential contractual obligations are those, the fulfillment of which enables the proper execution of the contract in the first place and on the fulfillment of which you can rely.

12.2 The same applies to breaches of duty by our vicarious agents and legal representatives.

§ 13 final clause

13.1 These general terms of use regulate the contractual relationship comprehensively and conclusively. Changes and additions must be made in writing to be effective. This also applies to the cancellation of this written form clause.

13.2 Should one of these general terms and conditions be ineffective, the rest of the contract remains effective. In place of the ineffective provision, the relevant statutory provisions apply.

13.3 The law of the Federal Republic of Germany applies to the exclusion of the provisions of the UN Sales Convention (CISG).
